2. By using our Website, you accept these terms

By accessing or using the Website, you agree to these Terms of Use and to our Privacy Policy, which is incorporated by reference. If you do not agree, please do not use the Website.

We may update these Terms of Use at any time by posting the revised version on this page. Changes take effect when posted. We may also modify, suspend, or withdraw all or part of the Website without notice. Your continued use after changes are posted means you accept them.

4. Using our Website

You agree to use the Website only for lawful purposes. You must not:

• use the Website in any way that breaches any applicable law or regulation;
• attempt to gain unauthorised access to the Website, its servers, or any connected system;
• introduce malware, viruses, or other harmful material;

If you send us ideas, feedback, or other materials about the Website or our services, you grant us a perpetual, royalty-free, worldwide licence to use them for any purpose without obligation or compensation to you. Please do not send us anything you consider confidential unless we have agreed in writing to treat it as such.

9. Linking, and sites we link to

You may link to our home page in a way that is fair and lawful and does not damage our reputation. You must not frame the Website or imply any association or endorsement that does not exist. We may withdraw linking permission at any time. Where the Website links to third-party sites, those links are provided for convenience only; we do not control and are not responsible for those sites or their content.

10. Our services

These Terms of Use govern your use of the Website only. Any engagement for our services, including a pilot, is governed by a separate written agreement between you and ASI. If there is any inconsistency between these Terms of Use and a signed services agreement, the signed agreement prevails for that engagement.

11. Australian Consumer Law

Nothing in these Terms of Use excludes, restricts, or modifies any guarantee, right, or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where our liability for a failure to comply with a consumer guarantee can be limited, our liability is limited, at our option, to re-supplying the relevant services or paying the cost of having them re-supplied.

12. Limitation of liability

To the extent permitted by law, and subject to clause 11, we are not liable for any indirect, incidental, or consequential loss, or any loss of profit, revenue, data, or goodwill, arising from your use of, or inability to use, the Website. To the extent permitted by law, our total liability arising out of or in connection with the Website is limited to AUD 100.

13. Indemnity

To the extent permitted by law, you agree to indemnify us against any loss, liability, cost, or expense, including reasonable legal fees, arising from your breach of these Terms of Use or your misuse of the Website.

14. Governing law

These Terms of Use are governed by the laws of Australia. You and we submit to the non-exclusive jurisdiction of the courts of Australia and the courts entitled to hear appeals from them.

15. General

If any part of these Terms of Use is found to be unenforceable, the rest continues to apply. Our failure to enforce any right is not a waiver of that right.
